PARTIES

1.1. This Privacy Policy describes how Itzabot ("Itzabot", "we" or "our") collects, uses, stores, shares, and protects your information in relation to the services offered by Itzabot, including, among others, the services provided on or through the domain www.Itzabot.com (the "Site"); tools or applications, including, among others, mobile applications and other programs related to the Site (the "Applications"); and images, texts, playlists, metadata, and other materials available through the Service (the "Content") (collectively, the "Service").

1.2. This Privacy Policy applies when you ("you", "User" or "Respondent") access, visit, or use any part of the Service. For the purposes of this Privacy Policy, a "User" is a person who creates chatbots, and a "Respondent" is a person who responds to those chatbots.

1.3. This Privacy Policy is part of the terms and conditions set forth in the Itzabot Terms of Use and is governed by them.

ACCEPTANCE OF THE TERMS OF THE PRIVACY POLICY

2.1. Any Service provided by Itzabot is completely voluntary. You are not required to provide us with personal information unless you choose to access Service features that require such information. If you do not agree with the terms of this policy or with the Itzabot Terms of Use related to the Service, please do not provide us with personal information, exit the Applications immediately, and stop using the Service.

2.2. Consequently, by creating an Itzabot Account (as defined in the Terms of Use), or by accessing, visiting, or using the Service in any other way, you expressly consent to our collection, use, disclosure, and retention of your information as described in this Privacy Policy and in the Itzabot Terms of Use.

CHANGES TO THE PRIVACY POLICY

3.1. We may occasionally modify this Privacy Policy. You may be asked to accept the modified Privacy Policy when logging into your Itzabot Account in order to continue using the Service. Alternatively, we may post any material changes to this Privacy Policy on the Site with prior notice before the changes take effect. We may also notify you of material changes to this Privacy Policy before the effective date by sending you an email or another visible means that provides you with a reasonable notice period. If you do not agree with the new Privacy Policy, you may stop using the Service within the applicable thirty (30) day period and will not be subject to the new terms. Otherwise, the new terms will take effect after thirty (30) days.

Your Data Protection Rights and Options

You, including any data subject whose personal data is processed by Itzabot in its capacity as data controller, may have the following rights depending on the applicable legislation in your jurisdiction:

4.1 If you wish to confirm the existence of the processing of your personal data or access the personal data that Itzabot collects, you can do so at any time by contacting us.

4.2 You can also contact us to update or correct incomplete, inaccurate, or outdated information, or to delete information from your account. Please see more details on how to delete your account.

4.3 You have the right to request information about data sharing and with whom it is shared.

4.4 You have the right to request information about the possibility of not giving consent and the consequences of refusal.

4.5 If you are in the European Economic Area ("EEA"), the United Kingdom, Brazil, or Switzerland, you can object to the processing of your personal data, request that we restrict the processing of your personal data processed with consent, or request the portability of your personal data when technically feasible.

4.6 Similarly, if you are in the EEA, the United Kingdom, Brazil, or Switzerland, and provided that we have collected and processed your personal data based on your consent, you can withdraw that consent at any time. Withdrawing your consent will not affect the lawfulness of any processing carried out before your withdrawal, nor will it affect the processing of your personal data carried out based on other legal grounds.

4.7 You have the right not to be subject to a decision based solely on automated processing, including profiling, that produces legal effects ("Automated Decision-Making").

4.8 You have the right to obtain additional information about international transfers of your Personal Data and to access the contractual regulation of such transfers.

4.9 You have the right to lodge a complaint with a data protection authority regarding our collection and use of your personal data.

4.10 You have the right to designate a person who will exercise your data protection rights on your behalf in the event of death or incapacity. You can send the name and contact details of the designated person by writing to us at admin@Itzabot.com. Upon verification, the designated person will be authorized to make requests related to your personal data, including access, correction, deletion, or filing complaints.

You can submit your request by sending an email to admin@Itzabot.com. We will respond to all requests in accordance with applicable data protection laws.

Access to Data Controlled by Our Clients. We do not have direct contractual relationships with the Subscribers of our clients, that is, the individuals whose personal data is stored by our clients in the Service. It is recommended that anyone seeking access, correction, modification, or deletion of personal data processed in the Service by our clients initially direct their request to the Client.

PERSONAL INFORMATION ABOUT USERS AND RESPONDENTS

Itzabot is used by "Users" (you) and by "Respondents" (your users). The information we receive from Users and Respondents and how we manage it differs, as detailed below.

5.1. Users of Itzabot

As a User, we collect information related to you and your use of our Services from various sources:

(i) Information we collect directly from the User

a) Registration information: information you provide when registering for an account.

b) Chatbot data: we store your chatbot data (questions and answers).

c) Plan and billing information: we store information about your billing plan. If you have provided us with your billing details, this information is also stored.

d) Other data you wish to share: we may collect your personal information or data if you provide it to us in other contexts. For example, if you provide us with a testimonial or when running a campaign with Itzabot's chatbots.

(ii) Information we collect about the User indirectly or passively when interacting with us

a) Usage data: Itzabot collects usage data about the User every time they interact with our services.

b) Device and application data: Itzabot collects data from the device and application that the User uses to access our services, such as the IP address and browser type. We may also infer the geographical location based on the User's IP address.

c) Referral data: if the User arrives at an Itzabot website from an external source (such as a link on another website or in an email), we record information about the source that referred the User.

d) Third-party information: Itzabot may collect personal information or data from the User from third parties if the User gives those third parties permission to share such information with us.

e) Cookie information: Itzabot uses third-party tracking services that employ cookies to collect aggregated and anonymized data about visitors to our websites. This data may include usage statistics and User information.

5.2. Itzabot Respondents

As a Respondent, when you respond to chatbots hosted by Itzabot, we collect, on behalf of and under the instructions of the Users, information related to you and your use of our services from various sources:

(i) Information we collect directly from the Respondent: chatbot responses

We collect and store the chatbot responses provided by the Respondents. The Itzabot User is responsible for that data and manages it. Typically, the Itzabot User is the same person who invited the Respondent to use the chatbot and may sometimes have their own privacy policy.

By responding to a chatbot, you may provide personal information or data. Please note that Itzabot is not responsible for the content of that chatbot, so if you have questions about a chatbot you are responding to, you should contact the Itzabot User directly.

(ii) Information we collect about the Respondent from other sources

a) Usage data: Itzabot collects usage data about the Respondent every time they interact with our services.

b) Device and application data: Itzabot collects data from the device and application that the Respondent uses to access our services, such as, among others, the IP address, browser type, and operating system. We may also infer the geographic location based on the Respondent's IP address.

c) Referral data: Itzabot records information about the source that referred the Respondent to a chatbot (for example, a link on a website or in an email).

d) Cookie information: Itzabot uses third-party tracking services that employ cookies to collect aggregated and anonymized data about visitors to our websites. This data may include usage statistics and user information.

e) Email address: Chat records the Respondent's email address if the User adds an email question to their chatbots. The Respondent may choose not to provide their email address during a conversation with chatbots created by Users through Itzabot.

PURPOSES OF USE AND SHARING OF INFORMATION

6.1 We use the information we collect from you to provide the requested services related to the selected "Itzabot Account" for the purposes described in the Terms of Use.

6.2 We also use your information to review, research, and analyze how to improve the services provided. Additionally, we may collect and analyze your data to monitor, maintain, and enhance our services and features.

6.3 We conduct internal statistical and other analyses on the information we collect (including usage data, device data, referral data, questions, and answers) to analyze and measure user behavior and trends, understand how they use our services, and monitor, troubleshoot, and improve our services, including helping us evaluate or develop new features.

6.4 We may use your information for internal purposes aimed at keeping our services secure and operational, such as testing, troubleshooting, preventing abusive activities (e.g., fraud, spam, or phishing), as well as for service improvement, research, and development.

6.5 Similarly, we collect your personal data in order to respond to your inquiries and provide you with advice and news from Itzabot about chatbots through any means, including email and similar electronic communication methods. To maximize the personalization of such information and commercial communications, Itzabot may use statistical techniques to create user profiles and data segmentation.

If you do not wish to receive such information and commercial communications, regardless of the communication method used, please inform us free of charge through the aforementioned means to exercise your rights. Your consent to receive information can be revoked at any time, although such revocation will not have retroactive effects.

6.6 We do not sell your chatbot data to third parties without your permission. We share your information with service providers who help us deliver our services, in which case these third parties are required to comply with our privacy policy and any other appropriate technical and organizational measures. We contractually bind these providers to keep your information confidential and to use it solely for the purpose of providing their services and in accordance with applicable privacy legislation in India. Your acceptance of the terms of this Privacy Policy followed by the submission of information related to the Service represents your agreement with this practice. If you do not wish for your information to be transferred, processed, or stored in the EU or the United States, you should not use the Service.

6.7 Your data will not be disclosed to third parties except:

(i) to provide the requested services for which Itzabot collaborates with third parties,

(ii) when we have your permission,

(iii) when required by a competent authority in the exercise of its functions (for example, to investigate, prevent, or take action regarding illegal activities), or

(iv) when required by law.

6.8 We do not use your chatbot data for purposes other than those described in this Privacy Policy and the Terms of Use.

6.9 Our servers, where we store your personal data, are located in AWS / Stockholm (eu-north-1).

6.10 Our subprocessors comply with the Privacy Shield Principles for all subsequent transfers of personal data from the EU and Switzerland.

6.11 If the ownership of all or substantially all of our business changes, or we carry out a corporate reorganization (including a merger or consolidation), or any other action or transfer between Itzabot entities, you expressly consent to Itzabot transferring your information to the new owner or successor entity so that we can continue to provide our services. If necessary, Itzabot will notify the applicable data protection authority in each jurisdiction about such transfer in accordance with the notification procedures established in the applicable data protection laws.

WHAT ARE COOKIES?

Cookies are small text files stored on your device (computer, tablet, or mobile) when you visit a website. They are commonly used to recognize your device, remember preferences, and provide certain functionalities.

7.1 OUR CURRENT USE OF COOKIES

As of the date of this policy, we do not use any type of cookies, including:

(i) Strictly necessary cookies

(ii) Performance and analytics cookies

(iii) Functional cookies

(iv) Advertising and targeting cookies

7.2 FUTURE USE OF COOKIES

If we introduce cookies or similar technologies in the future to enhance website performance, user experience, or any other purpose, we will do the following:

(i) Update this Cookie Policy to provide clear and detailed information.

(ii) Request user consent when required by applicable laws (e.g., GDPR).

(iii) Provide options to manage cookie preferences.

7.3 CHILDREN'S PRIVACY

Our website is not intended for children under 16 years old. Since we currently do not use cookies, we do not knowingly collect cookie-based data from minors.

7.4 UPDATES TO THIS COOKIE POLICY

We may update this Cookie Policy periodically if our practices change. Any updates will be posted on this page and, when legally required, we will request your consent before activating non-essential cookies.

CANCELLATION OF YOUR ACCOUNT, OPTING OUT OF EMAILS, AND MODIFICATION OF PERSONAL INFORMATION

8.1 You may cancel your account and opt out of receiving emails from Itzabot at any time by contacting us at support@Itzabot.com. Deleting your account will result in all chatbot data associated with the account being permanently deleted from our systems within a reasonable timeframe permitted by law and will disable your access to any other service that requires an Itzabot account. We will respond to any such requests, and to any appropriate requests for access, correction, updating, or deletion of your personal information within the timeframe established by law (if applicable) or without undue delay. We will promptly comply with requests for the deletion of personal data, unless the request is not technically feasible or such data must be retained by law (in which case we will block access to such data, as required by law).

8.2 You may modify your personal information by electronically communicating the changes that need to be made.

8.3 We recommend that you immediately update your personal information when it changes. Information related to your past behavior on the Service may be retained by Itzabot for as long as necessary for the purposes stated above.

RETENTION OF YOUR INFORMATION

9.1 We retain information from active Itzabot accounts as long as it is necessary and relevant for our operations. Additionally, we may retain information from closed accounts to comply with the law, prevent fraud, collect owed fees, resolve disputes, troubleshoot issues, assist in investigations, enforce Itzabot's Terms of Service, and carry out other actions permitted by law. The information we retain about you will be handled in accordance with this Privacy Policy.

USE OF GOOGLE WORKSPACE API AND ACCESSED DATA

10.1 We strictly comply with the terms of service and privacy regulations of all third-party APIs used in our products. We do not use Google Workspace APIs to develop, enhance, or train generalized artificial intelligence (AI) and/or machine learning (ML) models. Our use of these APIs is strictly limited to the specified purposes, ensuring compliance with all applicable laws and Google policies.
